Terms of Use

1. Acceptance

By accessing or using Vesper ("the Service"), you agree to these Terms of Use. If you do not agree, do not use the Service. The Service is operated by Elenchus Inc. ("we," "us," "our").

2. Eligibility

You must be at least 18 years old to use Vesper. The Service is currently available by invitation only during our closed beta period.

3. Account & Access

You are responsible for maintaining the confidentiality of your login credentials. Invite codes are single-use and non-transferable. We reserve the right to suspend or terminate accounts that violate these terms or compromise the integrity of the beta.

4. The Service

Vesper provides AI-generated character interactions for entertainment and creative exploration. Characters are fictional psychological constructs. Their responses are generated by machine learning models and do not constitute professional advice of any kind — including but not limited to medical, psychological, legal, or financial advice.

5. AI-Generated Content

All character dialogue, art, and behavioral outputs are generated by AI systems. These outputs may be unpredictable, inaccurate, or inappropriate. You acknowledge that AI-generated content does not reflect the views or endorsement of Elenchus Inc. We make no warranty regarding the accuracy, completeness, or suitability of any AI-generated output.

6. User Conduct

You agree not to: (a) attempt to extract, reverse-engineer, or replicate the underlying systems, models, or proprietary technology; (b) use the Service to generate content that is illegal, harmful, or violates the rights of others; (c) share your account credentials or invite codes; (d) use automated tools to access the Service; (e) attempt to circumvent rate limits or access controls.

7. Intellectual Property

All proprietary technology, systems, methods, and trade secrets underlying the Service are the exclusive property of Elenchus Inc. and are protected by patent applications and applicable intellectual property law. Your use of the Service grants you no rights to our intellectual property beyond the limited license to use the Service as intended.

8. User Content

You retain ownership of the messages you send. By using the Service, you grant us a limited license to process your messages through our AI systems for the purpose of generating responses. We do not sell your content. See our Privacy Policy for details on data handling.

9. Beta Disclaimer

The Service is in closed beta. It is provided "as is" and "as available" without warranties of any kind, express or implied. We may modify, suspend, or discontinue any aspect of the Service at any time without notice. Data loss may occur. Features may change.

10. Limitation of Liability

To the maximum extent permitted by law, Elenchus Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to emotional distress from AI-generated content.

11. Modifications

We may update these terms at any time. Continued use of the Service after changes constitutes acceptance of the revised terms.
