1. Acceptance
By accessing or using Vesper ("the Service"), you agree to these Terms of Use. If you do not agree, do not use the Service. The Service is operated by Elenchus Inc. ("we," "us," "our").
2. Eligibility
You must be at least 18 years old to use Vesper. By creating an account you confirm that you are. Vesper is in open beta: anyone 18 or over can sign up.
3. Account & Access
You are responsible for maintaining the confidentiality of your login credentials. We reserve the right to suspend or terminate accounts that violate these terms.
4. The Service
Vesper provides AI-generated character interactions for entertainment and creative exploration. Characters are fictional psychological constructs. Their responses are generated by machine learning models and do not constitute professional advice of any kind — including but not limited to medical, psychological, legal, or financial advice.
5. AI-Generated Content
All character dialogue, art, and behavioral outputs are generated by AI systems. These outputs may be unpredictable, inaccurate, or inappropriate. You acknowledge that AI-generated content does not reflect the views or endorsement of Elenchus Inc. We make no warranty regarding the accuracy, completeness, or suitability of any AI-generated output.
6. Content
Vesper is a fiction platform for adults. Stories may include mature themes, including violence, horror, cruelty, and sexual content between adult characters. Beyond the rules below, Vesper does not add a content filter of its own. The AI models we use (currently Google Gemini, Anthropic Claude and DeepSeek) have their own limits, and a reply may be refused or cut short when a model declines. Characters are written as people, and a character may also refuse for reasons of their own.
The following are never allowed, in any story, under any framing: (a) sexual or romantic content involving anyone under 18, or any character depicted as under 18 by age, appearance or role, whatever age is claimed for them; (b) sexual content depicting real, identifiable people; (c) content that is illegal where you live, or that is used to harass, threaten or defraud a real person.
Characters in our library who are minors in their source material refuse such content, and attempts are logged. Imported cards that depict minors are rejected at import. We may remove content and suspend or terminate accounts that break these rules, and we report to authorities where the law requires.
7. User Conduct
You agree not to: (a) attempt to extract, reverse-engineer, or replicate the underlying systems, models, or proprietary technology; (b) use the Service to generate content prohibited under Section 6, or content that is illegal or violates the rights of others; (c) share your account credentials; (d) use automated tools to access the Service; (e) attempt to circumvent rate limits or access controls.
8. Intellectual Property
All proprietary technology, systems, methods, and trade secrets underlying the Service are the exclusive property of Elenchus Inc. and are protected by patent applications and applicable intellectual property law. Your use of the Service grants you no rights to our intellectual property beyond the limited license to use the Service as intended.
9. Your Content
You retain ownership of the messages you send and the stories you write. By using the Service, you grant us a limited license to process your messages through our AI systems for the purpose of generating responses. We do not sell your content. See our

10. Imported Characters
You may import character cards you made or have the right to use. You keep whatever rights you hold in a card; importing gives us a limited license to store and process it so you can use it on Vesper. Imports are private to you unless you share the link. We credit the card's author where the card names one. If you are a creator and want your card removed, email
nadir@heyvesper.io and we will remove it.
11. Beta & Pricing
The Service is in beta. It is provided "as is" and "as available" without warranties of any kind, express or implied. We may modify, suspend, or discontinue any aspect of the Service at any time without notice. Data loss may occur. Features may change. Vesper is currently free. We will announce any paid plans before they take effect.
12. Limitation of Liability
To the maximum extent permitted by law, Elenchus Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to emotional distress from AI-generated content.
13. Modifications
We may update these terms at any time. Continued use of the Service after changes constitutes acceptance of the revised terms.
